RE: Issue's arising from our work within the JMB/JMC

Dear Dato' Ho,

Thank you and your staff for the co-operation received to date; as we move forward to manage Miami Green. Regrettably we find there are some issues requiring further confirmation; the issues mentioned below are the most important ones at the moment. As you know we (JMC) are duty bound to raise such issues as we are the elected committee and accountable to the owners of Miami Green.

Owner's Update

Dear Neighbours,

Please take note of the following information:

  1. The monies on deposit in the Condominium's Bank Accounts is over RM 1 MilIion; fixed deposit accounts are earning us profits at a higher rate then under Belleview's 'Management". This monies come from the Sinking Fund RM 809,290.00 and the Current Account RM 163,000.00. No commitments have been made to the Developer in respect to the accuracy or veracity of the accounts presented.
  2. In order to have continuity, we have hired the current staff of 4 persons; who will be under direct employment of the JMB from 1st August 2008.
  3. This action has saved us the Belleview Management Fee of RM2 5,065.00 per month or RM 300,780.00 per year.
  4. Belleview has waived their management fee for July to assist us in setting up expenses for our Management Office; it being the case that our on site office had backup from Belleview which no longer exists.
  5. The Management software for the Condominium which we already own; is under review because we are considering your needs as well as looking for efficiency savings; as well as your needs to access to your own confidential records. Apparently the current software is well out of date and offers no website access and has little use other than accounting.
  6. A lawyer's services Mr Chan Hon Wai has been secured to advise on legal matters and will assists us in solving legal issues of which, there are many; relating to the Developer, as well as advice on Service Charge debts and how to take action against those debtors.
  7. An Accountant's service has been retained to ensure accurate accounting rather than a full time employee.
  8. The JMC have considered whether new management agent should be appointed; but would like to try running with our on site Manager and JMC Management; it is the lowest cost solution. The formation of the Management Corporation can soon occur; and the current JMC is putting in many hours to ensure its smooth handover.
  9. Current Service Provider has been retained by the JMB, these Service Providers will be required to perform to the contract obligations in order to ensure high standards.
  10. Any owners who has not paid service charges due to the Developer should now know that the Developer cannot access the service charge accounts any more; and as such should pay the outstanding amount or face legal action from the JMB or MC when formed.
  11. The current staff replaced all the missing window slats at the fire escape stairwells without cost as some glass was available; by hand cutting every pane to size.
  12. A re-painting of the gloss paint on doors in common areas is underway; Block A finished; Block B partly done; as well as the stairs leading to the pool deck between Block A and B which had been covered in sap from plants.
  13. Mr. Foo has been retained for his knowledge and experience of Miami Green. This is important because many of the architectural plans do not reflect the actual layout. Employee job descriptions are in progress.
  14. Regular site inspections take place and feedback is given to the Service Provider and Maintenance Staff.
  15. Major areas on site concern relate to instances of vandalism; urinating in public; abuse of Security Staff; food thrown out for monkeys.
  16. Three (3) out of twelve (12) commitee members James Yeoh, Kris Lee and Jason Pin have resigned from the JMC as of last week. for personal reasons. The COD has been informed. The JMC will continue as is with the remaining number of its members, as allowed under ACT 663 and with consultation from COB.
  17. Further savings are considered, now that the running cost for Miami Green has been reduced the monthly outgoings will be aroundRM 90,000.00. Investigation of additional cost reductions that can be made on Electricity this could be achieved by the use of battery powered solar charged lighting the study is ongoing; estimated cost reduction in the region of RM 15,000.00 per month could be achieved.
  18. The gymnasium equipment, which seldom functions satisfactorily for long, may well be replaced from the supplier who can provide and maintain such equipment. This is currently under investigation.
